Unlikely typical insurance will net him replacement value of his car, so in all likelihood he'll need to sue for the difference. Since she is clearly at fault, he'll likely be able to win a settlement for replacement value, and her stupidity deserves the cost of replacement.

I'll add my condolences.  As a fellow red Aero owner, I feel your pain.  That sucks.  But like everyone else has said, you can replace a car.  The more important thing is that you're OK.

No need to sue. Document everything, know the value of your car, be honest/fair/reasonable, and BE PERSISTENT while knowing the terms of your insurance policy, the other parties policy and coverage, as well as your RIGHTS.   banghead

OH AND... make sure you have alternate transport, buy a cheap temp rig, 'cause the process can take month(s).

Well, it is totaled.  I was strangely fortunate that the damage adjuster let me go get a bunch of parts off of it before it will be auctioned of to a salvage yard.  I will hang onto them for now in case i get another subie they can fit on.  If i decide to sell anything i will post it up here.

My wrist is fine i think.  Rotating and stuff doesn't really hurt.  It hurts mostly when i try squeezing something.  No fractures.  It will probably be sore for a little while. 

I'm not going to sue.  I think i am getting a fair amount for the car (~$11,600).  Since I am not seriously hurt I don't think it will be worth the legal fees and time just to attempt to hold her ass to the fire.  In my official statement to her insurance I stated that I believed she was distracted by something, likely her phone, and that there was really no other rational explanation for why she did what she did.  I hope they raise her rates a lot.  Other than vindictiveness, I am not sure what plus side sueing would have. 

My fiancee should be taking delivery of her 2012 Impreza Sport Limited any day now.  I will drive around her old Nissan until I find a new car.  Since her new Impreza will be our economical and practical hatchback, i am free to look around for a less practical car.  I am going to look very hard for a good example of a 2007 STi Limited.  It will cost me more than replacing Ruby with another Saabaru or a WRX, but the upgrade would make me feel better atleast.  Plus my downpipe, ebcs, ixizhood, etc, will swap right onto it.

I completely agree. There are way too many people who abuse the system, and as long as you are not financially screwed over by the situation I see no need to sue. Also  up  up on the STi Limited. I love how they look with small lip on the trunk instead of the huge spoiler, and the black interior is nice. Keep us posted on your search though.

Bummer, glad to hear you were OK. Can be assured they will total it and then low ball you on replacement value. Trust me they did it to mine. they offered me $7500. I asked to keep the car they said I could buy it for $1500 and have a salvage title. I took the cash and found another one, only problem it is an Auto.
